Stay of Proceedings for Charlton Case

Two-time One Bermuda Alliance candidate and former chairman of the West End Development Corporation (WEDCO) Ray Charlton appeared in Magistrate’s Court this morning for sentencing after being found guilty of a 2018 sexual assault a few months ago.

With this new information provided by Bermuda Hospitals Board (BHB) Forensic Psychiatrist Sebastian Henagulph, Mr. Charlton could not be sentenced today.

Dr. Henegulph’s professional observation initially determined that Mr. Charlton was not suitable for Mental Health Treatment Court, but wrote this afternoon that his case should be heard in another court. With this in mind, Mr. Charlton’s counsel Elizabeth Christopher voiced her intention to the court to file a notice of appeal for the case within the next seven days.

Magistrate the Worshipful Craig Attridge ordered a stay of proceedings for this case and gave Ms. Christopher seven days to file the appeal. If it is not filed within that time frame, the Crown will seek to have the case brought back down to the Magistrate’s Court for sentencing.

Because Mr. Charlton’s appeal must be heard in the Supreme Court, Magistrate’s Court cannot determine bail for him at this time and his new bail conditions will be determined by the Supreme Court.
