The trial of Curtis Richardson, who is accused in connection with the fatal Mother’s Day 2023 road traffic collision that claimed the life of Marco Warren, continued today with the Crown challenging evidence given by a former police officer who was involved in the investigation.
Lead prosecutor Carrington Mahoney cross-examined former police officer Phil Lewis, who was previously in charge of the Bermuda Police Service’s Forensic Accident Unit.
During questioning, Lewis acknowledged that key information from the initial investigation—including the 911 call recording—was not obtained or reviewed by him.
Mahoney questioned Lewis on whether obtaining the 911 information was a basic part of his responsibilities as a professional road collision investigator and whether the recording represented an important investigative tool.
Lewis acknowledged that he had overlooked obtaining the 911 recording.
The prosecution challenged the significance of that omission, with Mahoney suggesting that the information did not fit the narrative Lewis had presented in his evidence.
Evidence was also raised concerning the initial response to the collision scene. Lewis testified about the actions of a female police officer who was responsible for the scene and whom he identified as a TIC officer. According to the evidence presented, Lewis believed that a number of basic evidence-gathering procedures had not been properly followed during the early stages of the investigation.
Mahoney pressed Lewis on why, as an experienced collision investigator, he would not have obtained or ordered the 911 recording.
The prosecution also highlighted that Lewis had previously worked alongside Richardson when both were police officers.
Mahoney put to Lewis that the evidence he provided was effectively favourable to Richardson and that he had overlooked or ignored basic information that could have been relevant to the investigation.
Those assertions by the prosecution remain matters for the jury to consider. Richardson is presumed innocent unless and until the court determines otherwise.
The case concerns the May 2023 Mother’s Day road traffic collision that resulted in the death of Marco Warren, a young footballer who was pursuing a PhD.
