Man pleads guilty to DWI after overturn car RTA

A 30 year old Warwick man appeared in Magistrates Court to answer charges of Driving Whiles Impaired DWI.

Arrington Smith plead guilty to the charges. DPP Cindy Clarke stated that

1. On the 12’h day of May 2023, in Warwick Parish, did drive motor vehicle, on a road, namely, South Road, whilst your ability to do so was impaired by alcohol.

Contrary to Section 35AA of the Road Traffic Act 1947.

2. On the 12″ day of May 2023, in Warwick Parish, being a person whom a police officer acting on reasonable and probable grounds, believed was a person
committing an offence under Section 35 of the Road Traffic Act, 1947, did without
reasonable excuse, fail to comply with demand made by a police officer that
give a sample of breath for analysis ,

It was also stated by the DPP Clarke, that around 10:05 p.m. on Friday, May 12 th, 2023, police received a report of an overturned car near the junction of Frith Estate Road and South Road, Warwick.

It appears the 30-year-old male driver lost control of the vehicle and struck a palm tree, which resulted in the vehicle being flipped onto its roof.

The driver suffered a minor injury to the nose.

Senior Magistrate Maxanne Anderson Disqualified Smith from all vehicles and bailed the young man to the sum of $1000 as he is to return go court Tuesday at 2:30pm.
