“We welcome Justice Subair Williams’ ruling. While the decision is correct both legally and ethically, it is regrettable that the ruling comes after a second application for the trial judge’s recusal on the grounds of the appearance of bias – the court denied the first application.
Had it not been for the steadfastness of my legal team, the original ruling would still stand. What is particularly galling is that both the Deputy Governor and the DPP instructed outside counsel, at no doubt great expense to the public purse, to resist the application at every stage.
Nonetheless, this recent ruling is another step toward justice and ultimate vindication.
For nearly 11 years, and at a cost to the public of well over $10 million, my colleagues and I have been subjected to unfounded allegations, vicious lies, attacks on our livelihoods and unnecessary police searches and seizures.
After these years of persecution, the Bermuda Police Service formally informed us in March 2022 that since the investigation into medical fraud has been discontinued, and no charges will be laid against me or anyone in relation thereto, they had incinerated patient files.
This alleged incineration took place without any notice to my offices which they raided to get the files, or to the innocent patients whose privacy they horribly violated, trying to manufacture a crime with which to charge me.
Like the unfounded accusations of medical fraud, the remaining false allegations will not stand up against the scrutiny of the truth. I am innocent and will continue to pursue justice despite the financial and emotional cost – not just to me but to Bermuda.
My heart breaks when I think of the millions of dollars the government of Bermuda has literally thrown away, pursuing, and persecuting me – one Black man – which could have and should have been spent uplifting countless young Black men.
My faith, the unfailing support of my beloved wife and family, the prayers of my spiritual leaders and loved ones, and the support received from so many friends in Bermuda and elsewhere help me endure what can only be described as political persecution and a witch hunt. Yet, we fight on.” As Dr. Martin Luther King Jr. said, “We shall overcome because the arc of the moral universe is long, but it bends toward justice.”
